By using this website or requesting services from Ghosted Ai LLC, you agree to these Terms. The website and services are intended for business users who are at least 18 years old and able to form a binding agreement.

Ghosted Ai provides business technology and marketing services, including websites, funnels, CRM setup, pipeline automation, database reactivation, lead capture and routing support, social media support, Ai sales or reception agents, context memory systems, reporting, and related consulting.

Any signed proposal, statement of work, order form, invoice, or service agreement controls the specific scope, timing, deliverables, fees, usage allowances, and approval process for a project.

Ghosted Ai designs and operates systems intended to improve visibility, routing, follow-up, and operational consistency. Business results depend on many factors outside our control, including offer quality, market conditions, sales process, data quality, staffing, response speed, compliance status, platform availability, and customer behavior.

We do not guarantee revenue, profit, appointment volume, rankings, ad performance, deliverability, approval by a platform, or any specific result unless a separate written agreement expressly says otherwise.

Ai systems and automation can support sales, reception, marketing, reporting, and operations, but they are not a substitute for human judgment where review is required. Outputs can be incomplete, inaccurate, delayed, or affected by source data quality.

Client-facing campaigns, legal-sensitive content, compliance-sensitive messaging, and material business decisions should be reviewed by an authorized human before use.

• Provide accurate business, billing, access, brand, content, and approval information.
• Maintain lawful rights to any contacts, lead lists, customer data, content, images, reviews, logos, credentials, or platform access provided to Ghosted Ai.
• Review and approve public-facing content, forms, messages, automations, workflows, and launch decisions before they go live.
• Comply with applicable privacy, advertising, email, SMS, telemarketing, intellectual property, platform, and industry rules.
• Keep credentials, accounts, payment methods, calendars, phone numbers, domains, and platform permissions current and secure.

If you provide contact lists, lead data, customer records, conversation history, or CRM data, you represent that you have the lawful right to provide that information for the services requested.

You are responsible for the accuracy of consent records, opt-out status, suppression lists, and any required disclosures. Ghosted Ai may refuse, pause, or modify work that appears to involve purchased lists, scraped contacts, unclear consent, misleading claims, prohibited content, or material compliance risk.

Where services involve SMS, voice, email, chat, social messaging, or other communications, the parties must follow applicable law and platform rules, including consent, identification, opt-out, quiet-hour, recordkeeping, and message-content requirements.

Message and data rates may apply to message recipients. Message frequency varies by request, appointment activity, and service status. Recipients can reply STOP to unsubscribe where supported and HELP for help where supported. Wireless carriers are not liable for delayed or undelivered messages. The availability of SMS, voice, email, Ai, or other communication features may depend on third-party approvals, carrier requirements, A2P/10DLC registration, platform policies, and account status.

Clients are responsible for confirming the accuracy of business information, service descriptions, prices, images, testimonials, reviews, legal links, policies, and claims used in public-facing work.

Ghosted Ai may use publicly available business information, client-provided materials, and approved third-party tools to prepare drafts, but public launch requires client approval.

Fees may include setup fees, monthly management fees, usage-based charges, software costs, pass-through platform costs, ad spend, messaging/voice costs, implementation fees, and optional services.

Usage-based or pass-through charges may vary by connected service, activity level, third-party pricing, and approved system scope. Payment terms, renewal terms, cancellation terms, and refund terms are defined in the applicable proposal, invoice, or agreement.

Services may rely on third-party platforms such as CRM, calendar, messaging, voice, email, hosting, analytics, ad, payment, design, automation, Ai, database, and reporting providers.

Ghosted Ai does not control third-party outages, policy changes, pricing changes, data-processing practices, account approvals, rate limits, deliverability decisions, feature changes, or enforcement actions.

Ghosted Ai retains ownership of its pre-existing materials, templates, workflows, methods, prompts, processes, know-how, internal tools, documentation, and reusable system components.

Clients retain ownership of their pre-existing brand assets, approved content, and business data. Final ownership or license rights in project deliverables are governed by the applicable written agreement and payment status.

Each party should protect confidential information using reasonable care. No internet, cloud, CRM, messaging, or Ai system is completely secure. Clients should avoid providing unnecessary sensitive information and should use proper access controls for accounts, credentials, and user permissions.

You may not use the website or services for unlawful, deceptive, abusive, infringing, harassing, discriminatory, fraudulent, malicious, spam-related, or prohibited communications.

You may not attempt to interfere with the website or connected systems, bypass security controls, misuse forms, or use the services in a way that violates platform rules or applicable law.

Ghosted Ai may suspend or stop services if payment is overdue, required access is unavailable, instructions create legal or platform risk, data quality creates unreasonable risk, or continued work would violate these Terms or a related agreement.

Either party's termination rights are governed by the applicable written agreement.

The website and services are provided on an as-is and as-available basis to the maximum extent permitted by law. Ghosted Ai disclaims warranties of merchantability, fitness for a particular purpose, non-infringement, uninterrupted operation, and error-free performance, except where a separate written agreement states otherwise.

To the maximum extent permitted by law, Ghosted Ai is not liable for indirect, incidental, special, consequential, exemplary, punitive, lost-profit, lost-revenue, lost-data, business-interruption, platform-action, deliverability, or reputational damages.

Any aggregate liability is limited to the amount paid to Ghosted Ai for the specific service giving rise to the claim during the three months before the event, unless a separate written agreement states otherwise.

You agree to defend and indemnify Ghosted Ai from claims arising from your data, content, instructions, contact lists, consent records, platform access, legal or regulatory noncompliance, misuse of the services, or violation of these Terms.

These Terms are governed by the laws of the State of Nevada, without regard to conflict-of-law rules. Unless otherwise required by law or agreed in writing, disputes are resolved in the state or federal courts located in Clark County, Nevada.

Ghosted Ai may update these Terms from time to time. The effective date above shows when the current version took effect. Continued use of the website or services after an update means you accept the updated Terms.
